In the context of marketing advice, consultancy management (including organizing events), and providing performances and training, DLVX Digital Solutions CommV. is also a data processor. This is covered by agreements between DLVX and the data controllers. This is not part of the current Policy.

Depending on your capacity, we collect the following personal data:
From clients:

From prospects:

- Professional activities (including the nature of the activity, nature of goods/services used or provided by the person in the file, business relationships)
- Any other personal data that prospects lawfully provide to DLVX Digital Solutions CommV.

From suppliers:

you guarantee to DLVX Digital Solutions CommV. that:
- These personal data were lawfully obtained from the third party and lawfully provided to DLVX Digital Solutions CommV.;

- You have provided this person with relevant information about the existence and content of this Policy.

Why do we process personal data (purposes)?
Personal data are processed for the following purposes:

- Proper execution of the agreement;
- Issuing invoices and billing data;
- Customer service: to help you quickly in case of questions and/or problems;
- Sending surveys to improve our services;

- Sending newsletters, offers, promotions, etc., to prospects. You can always unsubscribe via the opt-out in the email;

- Preventing misuse or improper use of our services;
- Keeping personal data as evidence or for legal action;
- Keeping personal data to register attendance/participation in events.

3.4. Complying with legal obligations
- Complying with legal obligations (e.g., anti-money laundering and counter-terrorism laws);
- You are not obliged to share your personal data with us, but if you do not provide the requested personal data, we may not be able to provide you with the desired services and/or products.

Legal basis for processing personal data?
The processing of personal data under point 3.1 is based on the performance of the agreement or, at the request of the data subject, taking steps before entering into the agreement.
The processing of personal data under point 3.2 is based on the explicit consent of the data subject.
The processing of personal data under point 3.3 is based on the legitimate interest of our company (only when the legitimate interest of our company outweighs the interest of the data subjects). The interests were further outlined under point 3.3.
The processing of personal data under point 3.4 is to comply with legal obligations that rest on our company.

With whom do we share personal data?
We do not share personal data with third parties unless these parties are contractually bound to DLVX Digital Solutions CommV. or act on behalf of or subcontracted by DLVX Digital Solutions CommV. Of course, we have made agreements with these parties regarding the protection of your personal data.
We also do not share personal data with companies outside the European Economic Area unless there is an adequacy decision, appropriate safeguards, binding corporate rules, or transfers referred to in Article 49(1) GDPR.
In legally determined cases, we are required to share certain personal data with defined authorities.

How long do we keep personal data?
We only keep personal data as long as necessary for the exercise of the above-defined purposes. Since the retention period depends on the purpose and the type of personal data, retention periods vary.

What are your rights?

- Rectification: You have the right to have incorrect or incomplete personal data corrected.
- Erasure: You have the right to ask DLVX Invest CommV. to delete your data in the cases specified in Article 17(1) GDPR, such as if you withdraw your consent or object to processing for direct marketing. DLVX Invest CommV. will delete your data immediately, unless Article 17(3) GDPR applies. For example, DLVX Invest CommV. will not have to delete your personal data if it is necessary for fulfilling a legal obligation.

7.2. Right to restriction of processingYou have the right to restrict processing in the cases specified in Article 19(1), e.g., if the accuracy of the personal data is disputed.

7.3. Right to data portabilityYou have the right to request or transfer the personal data you provided to DLVX Invest CommV. to another company.

7.4. Right to withdraw consentYou have the right to withdraw your consent at any time. Withdrawing your consent does not affect the lawfulness of processing based on consent before its withdrawal.

7.5. Right to lodge a complaint with a supervisory authorityIf you disagree with DLVX Invest CommV.’s position, have comments on the exercise of your rights, or believe that the processing of your personal data is not in accordance with the law, including the GDPR, you can file a complaint with the supervisory authority (https://www.gegevensbeschermingsautoriteit.be/).

7.6. Right to object to processingYou always have the right to object to processing for direct marketing purposes. Practically, you can do this by marking “opt-out” in the emails, after which you will no longer receive direct marketing emails from us. However, we may still contact you regarding the performance of the agreement. You also have the right to object to processing based on Article 6(1)(e) or (f) GDPR.
